Who you are dealing with
The Techno Optimist (technooptimist.io and api.technooptimist.io) is run by [legal entity name: to be supplied], [registered address: to be supplied]. Questions about these terms: info@technooptimist.io.
By using the site or the API you accept these terms. If you subscribe for a business, you accept them for that business.
What the service is
- A monitoring service for technology programs: where each stands, how it works, what is hard, and the news about it, written up from public primary sources and linked to them.
- Information, not advice. Nothing here is investment, financial, legal, medical or engineering advice. Check the original source before you rely on a fact, especially for money or safety decisions.
- We work hard on accuracy (every story links its original; figures carry how they were obtained: reported, estimated or sample), but summaries can contain mistakes. Report one and we will correct it: see About.
Plans and payment
- A few pages are free to read in each browser. After that, reading needs the Reader plan ($10 a month). The API plan ($100 a month) and the API Commercial plan ($300 a month) add the data API and include the Reader plan. Current prices are on Pricing.
- Plans are monthly subscriptions in US dollars, paid in advance by card through Stripe, and renew each month until you cancel. Any tax due is shown at checkout.
- If we change a price, it applies to new subscriptions. We will tell existing subscribers at least 30 days before a change applies to them, and they can cancel before it does.
Cancelling and refunds
- Cancel any time from your account (Manage billing). Nothing more is charged, and you keep access until the end of the month you have paid for.
- A month already paid is not refunded for the days left after you cancel. If something went wrong (a double charge, a charge after cancelling, a plan you couldn’t use because of a fault on our side), write to info@technooptimist.io and we will refund it.
- If you are a consumer and the law where you live gives you a right to withdraw or to a refund, these terms do not limit it.
- Moving to a higher plan starts it at once; the lower plan then runs to the end of its paid month and stops renewing.
The API licence
Each API plan gives you a licence to use the data the API returns, for as long as you subscribe:
- API ($100/month): personal projects, academic or independent research, and analysis inside your own organisation. Not in a product or service that others use or pay for, and not for clients.
- API Commercial ($300/month): everything above, plus building the data into products and services you sell or run for others, client work and paid research. Credit “The Techno Optimist” where the data is shown.
- Under either plan you may not resell or give away the data as a dataset or feed of its own, or use it to build a service that substitutes for this one.
- Keys are for you (or your organisation) only. Keep them secret and server-side; you are responsible for calls made with them. Requests are unlimited within a fair-use ceiling of 20 per second per key.
- Data you stored while subscribed may stay in work you already published; stop adding new data from the API when the subscription ends.
Fair use of the site
- One subscription is for one person. Don’t share your sign-in.
- Don’t get around the free-page limit or the paywall, and don’t scrape the site: the API is the way to get the data.
- Don’t attack, overload or probe the service.
We may suspend an account that breaks these rules; for a paid plan we will tell you why first, unless the breach is serious.
Content and trademarks
The write-ups, structure and drawings on the site are ours. Company names, logos and product names belong to their owners and are used to identify them; photos are used under the licences listed on Credits. Short quotations with a link back are welcome.
Availability and liability
- We aim to keep the site and API running at all times but can’t promise they never fail or change. We may add, change or retire features; a change that takes away something you pay for comes with notice and the right to cancel.
- As far as the law allows, our total liability to you is limited to what you paid us in the 12 months before the claim, and we are not liable for indirect losses such as lost profit. Nothing here limits liability that the law does not allow us to limit.
Changes and governing law
We may update these terms; the date at the top shows the current version, and we will email subscribers about changes that matter to them. These terms are governed by the law of [governing law: to be supplied], without taking away protections that consumer law where you live gives you.
